Zoning Question:
501 Fountain is in an RS 2 Zone. How is it that this single family residence can be rented to 4 individual college students under the age of 21?
Also, how is it that the LLC that manages it has changed 3-4 times this year?
According to the municipal code:
Residence Districts.
Section 12. - RS-2 Districts: General Single-Family.
Description and purpose. These districts exist for the protection of areas, most of them large in size, that have been and are being developed predominantly for single-family dwellings. Accordingly, the use of land and buildings within such areas is limited to single-family detached dwellings, and to such non-residential uses as generally support and harmonize with a low-density residential area. The non-residential uses permitted in RS-2 Districts, subject to adequate conditions and safeguards, are hereby found and declared to be the only appropriate such uses for such areas. It is hereby found and declared, further, that these regulations are necessary to the protection of these areas and that their protection is essential to the maintenance of a balanced community of sound residential areas of diverse types.

We are just seeing this post due to it being placed in "Other".
This property is not considered a rooming house so there is likely no violation with 4 people living there. You can always call LCI to inquire further at 203.946.7090.
Also, the LLC is allowed to transfer, likely doing refinances and all entities are inter-related , see info below:

Working on it with LCI, Housing, Zoning, getting run around. code says 4 is rooming house:

Rooming house means any dwelling, or that part of any dwelling, containing one (1) or more rooming units in which space is let by the owner or operator to four (4) or more persons. This term includes, but is not limited to, hotels, motels, group living residential occupancies and dwellings located in the city that house groups including fraternities and sororities that are not located on land owned by educational institutions. This term excludes hospitals, homes for the aged, community residences and health care facilities that are otherwise regulated by state law

There are other elements that make a property a rooming house beyond that one sentence per City legal staff.
We deal with this issue all of the time.
You are not getting the run around from LCI.
This portion of the language for Rooming unit is vital:
Rooming unit shall mean any room or group of rooms forming a single habitable unit used or intended to be used for living and sleeping, but not for cooking or eating purposes.

Thanks for this. This actually makes sense. The reality is that there is an inherent conflict of a group rental in the middle of single family homes.
My original question/concern is about zoning-/this is an R2 zone for single family homes.
My LCI rep has been EXTREMELY responsive, but there are limits to scope of LCI. Parking has been very responsive, but there are limits to scope there too. Housing has been responsive too, but again limits. So I’m not sure where to go next.
