It's owned by New Rich Development LLC [= Limited Liability Corporation] An LLC is a way for absentee landlords to "hide" and supposedly protect their personal assets from lawsuits--although recent court rulings have severely curtailed this "personal asset protection" . E.g. if they knowingly harbor drug dealers and you win a lawsuit against New Rich Development, you potentially could be awarded not only this house, but the owner's private home, car, bank assets, etc. as damages for what you are suffering as a resident. Pretty neat, huh? I have to call state government in Hartford Tuesday to find out who the LLC's "officers" are. These are the "real" owners.
P.S. We need more people in this neighborhood like you, Tammy, who are willing to stand up for their rights and not be intimidated by selfish, self-centered people who care about nothing but themselves .

I called the Secretary of State office in Hartford 860-509-6000 to find out the "officers" of New Rich Development LLC. The "Agent" of New Rich Development is David L. Richards. They have his address as 45 Orchard St. However, in violation of state law, he has not filed an annual report with the Secretary of State office since 1998 [which is when he started buying properties]. The City Tax Collector has his address as 263 Dixwell Ave., 2nd floor.

How Limited is Limited Liability? A member of an “LLC” such as New Rich Development can be held PERSONALLY LIABLE for many different types of claims, but they typically arise under claims based on the concept of "piercing the veil" of the LLC. A “member” of the LLC may find HIMSELF “liable” [in other words, his personal assets—home, bank accounts, car, etc.—may be awarded to a plaintiff in a lawsuit] under a theory developed under corporate law known as "piercing the corporate veil." The courts typically look at whether there is a unity of interest and ownership such that the SEPARATE PERSONALITY of the entity [e.g. New Rich Development LLC] and the owner [David L. Richards] no longer exists, and whether to respect the distinction between the owner and the entity WOULD BE AN INJUSTICE. In cases of “piercing the veil”, some facts that courts examine in lawsuits include:
• Failure to observe corporate formalities [e.g. failure to file annual reports with the Secretary of State]
• Non-functioning of OTHER officers or directors [e.g. there is only ONE officer: David L. Richards]
• Absence of corporate records [e.g. failure to file annual reports with the Secretary of State]
• Whether the corporation is a MERE FAÇADE for the operation of a single property owner [such as David L. Richards].

And because it's a "fake" LLC, any other assets of David L. Richards are game to claim as restitution for damages and suffering to neighboring residents...

With the reception of this letter and the attached complaints YOU NOW ARE FULLY AWARE of the illegal drug activity engaged in, and neighborhood nuisance created by, the tenants and their associates in your aforementioned property, who by their activities interfere in the safety and comfort of neighboring residents.

THEREFORE, be advised and HEREBY WARNED that if you do not IMMEDIATELY initiate an eviction against these tenants, it is the intention of me and my neighbors to carry out a CLASS ACTION LAWSUIT against your so-called “LLC” known as New Rich Development. Because WE ARE FULLY AWARE that this LLC is a mere façade for “agent David L. Richards”, also be advised that YOU PERSONALLY will be named defendant in our lawsuit. For a lawsuit to succeed two things are needed:
1.TESTIMONY by those residents affected by these tenants [I already have names of enough neighbors willing to do so, but if you want to help, contact me schaeferchristopher@yahoo.com ]
2.DOCUMENTATION of each violation/offense. So EACH TIME these tenants or their associates violate the law [deal drugs, make noise, create "nuisance", dump trash on sidewalk, etc.] POST IT HERE.
Not only does it strengthen out lawsuit, it's also a great way to vent your anger [without busting their skulls LOL]

Only one person was arrested. We all know that at LEAST a dozen of his associates terrorized and intimidated our neighborhood. The person who told us to "Mind your own business" IS STILL LIVING THERE!!!!!

At the last Hill South Team Management meeting [which I was unable to attend] Sgt. Miller gave an update about this property. Unfortunately, people to whom I've spoken & who attended couldn't hear him due to poor acoustics in the Betsy Ross building. Anyone who attended and heard what he said, can you update us here? Something about tenants about to lose Section 8?

Ok when?will it be this year,or next?

299 tenants have been renting or buying new cars,one last week now another one. Section 8 people are not suppose to be able to afford to buy or rent new cars. They still throw trash in front of the house,now they have a big trash bag hanging on the fence!

Neighbors, if this property is still a problem, I can't help you unless you post a description of what's going on here EVERY DAY. I don't live within an "observable distance" to this house, and rumors don't hold up in a court of law. So if there's a problem, POST WHAT YOU SEE HERE. EVERY DAY. Thanks.

From New Haven Register, Saturday, July 30: "A 19-year-old city man was killed in a shooting...Friday evening...an officer in the area of Third Street and Howard Avenue heard a gunshot at 7:43 p.m. The victim, identified as Michael Holland of Newhallville, was found wounded in the midblock of Third Street, generally a quiet, residential neighborhood, and was taken to Yale-New Haven Hospital, where he died." Note that the victim was shot where drug dealing on Third St.--originating from 299 Greenwich Ave.-- continues to take place. Despite repeated complaints by residents, and despite last month's arrest of a 17-year-old dealer at 299 Greenwich--who had 2 guns. So is it the new police strategy to simply let these kids kill each other until there's no one left to arrest???

Note that the alleged murderer was booked for drug dealing, then released, just 2 days before the shooting. Also note that dealing continues unabated where the victim was found. Also note that the 17-year-old with 2 guns at 299 also was booked then bonded out. But of course, none of this is related.
Every time I call the police non-emergency number, the dispatcher gives me a different number to contact narcotics. So at 9 AM I'll try to call Chief Limon.
On a positive note, today's article mentions that several witnesses came forward to identify the alleged murderer--something that just doesn't happen in most neighborhoods. So with good neighbors like that, this place can only get better!

I called Chief Limon's office at 9 AM. Was only able to talk to the officer answering the chief's phone. I mentioned that dispatchers give different phone numbers every time I call for narcotic's number, and that when I call those numbers all I get is voice mail--with a full mailbox. I also relayed all the information in my previous post (see above).
The officer said that narcotics often will let the dealing escalate so they can "catch bigger fish", but acknowledged that it can be frustrating for neighbors while we wait for them to do so. Let's see what happens...

They pay more attention to Morris Cove & East Rock because they have more expensive homes there, and so pay higher taxes.
I complained on the CityofNewHaven.com web 311 page that the police phone numbers on that website are out of date, and no one answers the phone numbers listed. Also the dispatchers at the non-emergency number 946-6316 don't even have current phone numbers, and have to shuffle papers for several minutes to find their out-dated list.
I received an email in response from the Chief Administrator's office to call them, which I did. I told them that it's great that Chief of Police Limon wants to put more emphasis on "Community Policing", but it means nothing if the "Community" can't effectively communicate with the police and provide information. And if residents feel that the police aren't responding to what information the community IS providing, then the community is going to get disgusted and give up.
I was told they are going to look into this ASAP.
I hope it's not just another empty promise.

Greenwich Avenue is famous for drug dealing, and you can bet those kids paid their dues to whatever cop is collecting it. The cops know all about it, but they make so much money it is so much easier to look the other way. The head of narcotics is Lt. Hoffman. Why should he care about drugs anywhere in New Haven, at the end of his shift he gets back in his car and goes back to BRANFORD. If he followed the city charter and had a residence in New Haven, he might be more inclined to do something about the problem. Remember back in the early 90's when Police Officer Joan Goad used to sit in his police cruiser, in uniform, and smoke crack right in front of everyone? This went on for years until he was videotaped doing drugs in a police cruiser and the Feds stepped in. The narcotics unit is fake, look at how corrupt it is. There is just too much money for these cops to make with drugs on the street. The narcotics unit will do a "bust", but if your "dues" are up to date you get a text the night before telling you to "be clean", meaning that if the cops break your door down to make it look like they are doing their job, they can't arrest the drug dealers because they are not holding. This narcotics squad knows all of this, and to the people that complain and suffer, they laugh behind your back, get into their cars and go back to the suburbs. Unfortunately, more and more, their own kids are found right on these very streets.

The cops obviously are not stopping the problem--but revocation of the tenant's Section 8 title will. Dealing drugs or knowingly harboring drug dealers is grounds for immediate revocation of Section 8.

299 Greenwich is located in the 6th Ward, Dolores Colon Alderman. Could Dolores please post here what she is going to do—before the Sept. 12 primary—to expedite revocation of this tenant’s Section 8 voucher? Thanks.

I've noticed more traffic on the hallock side of third street at 2 am and sometimes at 6 am, which is the time I come home from work. One car will park, no one gets out then another parks they get out stand in the middle of the street, and don't even care that I see it....just saw it again this sunday soon midnight, I was on my porch...and I've seen where the second car comes from, right from 3rd street the greenwich side, so now they are coming over here..

I just received a personal phone call from Norma Rodriguez-Reyes (203-376-0864), 6th ward alderman candidate, detailing how she plans to tackle this problem. First, she will call the landlord over on Whalley Ave., MosheLLC [see my previous posts] to let them know what the problem is. Secondly, she will contact Karen Dubois-Walton, executive director of Housing Authority of New Haven, to find out why this tenant’s Section 8 voucher wasn’t revoked previously—i.e. when they were relocated here from Rosette St. where they had been evicted due to drug dealing. Thirdly, she said she will PERSONALLY go over to 299 Greenwich and speak to the tenants!
So now I’m waiting to hear about Dolores Colon’s plan of action. Dolores?

I'm hoping this problem is taken care of as I said before, starting to see more traffic on my side of third street, people waiting in a car for another to arrive...saw it again last night around midnight...

Narcotics conducted an investigation and a search warrant was executed on 09/2/11. An arrest was made.

“The situation at 299 [Greenwich Ave.] cannot be ‘expedited’. The city CAN do all it can by following the procedures in place to disqualify Section 8 tenants from the Housing Authority of New Haven (HANH) programs. In this case, the Legal and Section 8 departments of HANH must carefully examine the arrest records for 299 Greenwich Ave that the New Haven Police Department have and then make a justified, legal determination on the merits of the case. If the evidence shows the renters of 299 are breaking the law they will lose their Section 8 voucher and no longer have the rent subsidy to remain in their home.
The legal steps must be followed because the city cannot afford litigation on this or any matter. The investigation to remove the family at the root of the problem at 299 also has to be looked into by the Department of Children and Family Services because there are children in the household. I close by repeating, the situation cannot be expedited. All is being done that can be done [by] LCI, HANH, New Haven Police Department, and good neighbors like you who bring these matters to the attention of the appropriate officials.
