Dear City of Ferndale,
We moved to Ferndale this month from Raleigh NC. Our address in Ferndale is 445 W Maplehurst St.
We have a concern regarding a large partially dead ash tree next door (455 W Maplehurst St.). This house is vacant else we would directly contact the residents of the house about our concern. Parts of the ash tree are now dead and branches are falling off. Limbs of the tree partially overhang our house and thus our concern that a falling piece of the tree could strike our new home. Enough of the tree is still alive that it seems that total failure of the whole tree is unlikely, but failure of the dead parts is imminent.
What is the procedure to address such a concern about a hazard tree?

Looks like it is going to be a wait for damage and make an insurance claim. My suggestion would be to send a certified letter to the owner on the tax rolls letting them know that the tree is a nuisance and a hazard. Keep a copy for the inevitable damage and cross your fingers no one gets injured.

First of all welcome to Ferndale! Secondly, Ferndale will not do anything regarding tree concerns on private property. Our brief history is as follows:
- neighbors tree behind us branch fell - totaled our garage. We were required to pay our insurance deductible to have the garage replaced
- same neighbors tree’s dead limbs fell on our garage roof which required us to replace the back half of our garage roof. Insurance Co. covered the claim, again we were required to cover the deductible
- Two weeks later another dead tree limb fell and damaged our two week old gutter; that cost was out of pocket. We did not submit this to our Ins. Co.
In summary, the Ins. Co. has invested >25k$ in our garage. We have paid >3k$ and the Ins. Co. will cancel after three claims for the same concerns. Neighbor will not take responsibility for his dead limbs hanging over our garage, nor let anyone on his property to trim “his dead limbs.” We have received quotes from six tree companies who “do not want to deal with our inconsiderate neighbor.”
I continue to struggle to understand why someone can have a tree on their property and not be responsible for the tree. We offered to pay 3k$ For the limbs to be removed over our property but again the companies do not want to get involved in dealing with the ignorant neighbor. We have been instructed by the Ins. Co. To hire a lawyer. The next incident will involve legal matters.

Thank you for contacting MiFerndale. The Department of Public Works (DPW) has provided an update on this request. An inspection was performed on the tree located at 445 W Maplehurst in August of 2022. The inspection results showed that the tree in question was in fair condition, not warranting a removal; however, a follow up inspection was set to be performed to reassess for trimming and health status of the tree. DPW has reached out to the City's Arborist, Davey, about when another inspection would be completed.
In regard to the tree at 455 W Maplehurst, unfortunately because the tree is on private property, unless it is considered a nuisance or will harm the right of way, it is up to that homeowner to inspect, remove, or maintain the tree.
I am moving this request to "in progress" and will update when I have a date for the new inspection on the tree located at 445 W Maplehurst.
